On July 30, 2024, the registry operator of the .LV top-level domain approved a domain name dispute resolution service provider.
Starting October 1, 2024, the Arbitration and Mediation Center of the World Intellectual Property Organization (WIPO) will provide dispute resolution for the .LV top-level domain.
Until now, all disputes concerning already registered .LV domain names were resolved through negotiations between the parties, general jurisdiction courts, or arbitration in accordance with the laws of the Republic of Latvia.
The goal of the .LV domain name out-of-court dispute resolution is to provide simple, effective, and quick resolution of domestic and cross-border disputes arising between the domain name holder and a person who believes the use of the domain name infringes their rights. This is especially important when one of the parties involved in the dispute is abroad.
The alternative resolution of domain name disputes is a meticulously structured process introduced by the registry operator. It ensures fairness by having a neutral third party (expert) carefully consider the arguments and evidence of both the domain name holder and the complainant (e.g., trademark owner) before making a decision. This decision is then enforced by the relevant top-level domain registry where the domain name is registered, providing a secure and reliable resolution process.
On September 1, 2023, the necessary amendments to the Policy for the acquisition of the right to use domain names under the top-level domain .lv came into force, introducing an out-of-court alternative dispute resolution procedure, as described in the documents:
