WIPO Dispute Resolution Service Now Available for .LV Domain Names

As of October 1, 2024, the World Intellectual Property Organization (WIPO) offers a new dispute resolution service for Latvia’s country code top-level domain (.LV). This service is based on Uniform Domain Name Dispute Resolution Policy (UDRP), with several key differences tailored specifically for the .LV domain.

The alternative resolution of domain name disputes is a meticulously structured process introduced by the registry operator. It ensures fairness by having a neutral third party (expert) carefully consider the arguments and evidence of both the domain name holder and the complainant (e.g., trademark owner) before making a decision. This decision is then enforced by the relevant top-level domain registry where the domain name is registered, providing a secure and reliable resolution process.

Key Differences Between UDRP and .LV Domain Name Dispute Resolution Policy:

  • Rights Covered: While the UDRP focuses solely on trademark protection, the .LV Dispute Resolution Policy (lvDRP) also protects trademarks registered in Latvia to which the Complainant has rights, geographical indications protected in Latvia or under European Union law, and merchant names (firm names) as registered in the Latvian Commercial Register.
  • Bad Faith: Under lvDRP, it is sufficient to prove that either the registration or the use of the disputed domain name was made in bad faith, whereas UDRP requires proof of both factors.
  • Administrative Panel: A single panel member will be appointed to review cases from the publicly available list of approved experts.
  • Mutual Jurisdiction: Latvian courts are designated as the mutual jurisdiction.
  • Language: The language of the dispute resolution proceeding will be Latvian unless the parties agree to use English. If both the Complainant and the Respondent are located outside of Latvia, the complaint can be filed in English.

The new .LV domain name dispute resolution service is another step toward ensuring fair and transparent domain name dispute resolution.
